1. Introduction
These Terms of Service ("Terms") govern the provision of exterior cleaning and maintenance services by Elevate Exteriors ("we", "us", "our", "Company") to our clients ("you", "your", "Client"). By accepting our quote or engaging our services, you agree to be bound by these Terms.
These Terms are governed by the laws of New South Wales, Australia, and any disputes will be subject to the jurisdiction of the courts of New South Wales.
2. Service Provision
2.1 Weather Conditions
We reserve the right to reschedule jobs without notice due to adverse weather conditions that may affect the quality of our work or pose safety risks to our staff. This includes but is not limited to rain, high winds, extreme temperatures, or other weather conditions that may compromise service quality or safety.
2.2 Additional Charges
Any reasonably unforeseen obstructions, abnormalities, or unseen variations discovered during the course of work may incur additional charges. We will notify you of any additional work required and obtain your approval before proceeding, where reasonably practicable.
2.3 Service Scope
Our guarantee covers only the scope of work provided in the signed quote. Any work outside the agreed scope will be subject to additional charges and separate agreement.
3. Cancellation Policy
3.1 Cancellation Fees
Jobs cancelled with less than 24 hours notice will incur a cancellation fee. The cancellation fee will be calculated as 50% of the quoted service cost or $100, whichever is greater.
3.2 Rescheduling
Rescheduling requests made with more than 24 hours notice will be accommodated at no additional charge, subject to availability.
4. Payment Terms
4.1 Deposit Requirements
Services over $800 require a 50% deposit to secure the booking. The deposit must be paid within 48 hours of quote acceptance to confirm the booking.
4.2 Commercial & NDIS Customers
Commercial and NDIS customers may negotiate their payment terms. Such arrangements must be agreed in writing before commencement of work.
4.3 Payment Methods
We accept cash, bank transfer, and major credit cards. Payment is due upon completion of work unless alternative arrangements have been made in writing.
4.4 Late Payment
We reserve the right to suspend services for accounts with outstanding payments. Interest may be charged on overdue accounts at a rate of 10% per annum.
5. Client Obligations
5.1 Property Access
Clients agree to provide uninterrupted access to the whole property for the agreed time. We will advise if we need indoor access for any reason.
5.2 Utilities
Clients agree to provide water and electricity without charge for the duration of the service.
5.3 Safety Information
Clients must inform us of any present dangers or hazards on the property that may affect our work or safety.
5.4 Furniture and Obstructions
You must inform us if you need us to move furniture or other items. Additional charges may apply for furniture moving services.
6. Photography and Documentation
Before and after photos may be taken for quality assurance and promotional purposes. Clients can opt-out of photographic documentation by informing us in writing before commencement of work.
7. Non-Solicitation
During engagement and for a period of 12 months thereafter, clients shall not solicit or encourage any Elevate Exteriors employee or independent contractor to engage with anyone privately for similar services.
8. Limitation of Liability
To the maximum extent permitted by law, our liability for any loss or damage arising from our services is limited to the amount paid for the specific service that gave rise to the claim.
We are not liable for any indirect, consequential, or special damages, including but not limited to loss of profits, business interruption, or loss of data.
Our public liability insurance covers up to $20 million. A copy of our insurance certificate is available upon request.
9. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, or other unforeseeable events.
10. Privacy and Data Protection
We are committed to protecting your privacy and personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. Personal information collected will be used solely for the purpose of providing our services and will not be disclosed to third parties without your consent, except as required by law.
11. Dispute Resolution
Any disputes arising from these Terms or our services will first be addressed through good faith negotiations between the parties.
If negotiations fail, disputes will be resolved through mediation before resorting to legal proceedings.
12. Amendments
We reserve the right to amend these Terms at any time. Updated Terms will be posted on our website and will apply to all new bookings from the date of posting.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

15. Acceptance
By accepting our quote or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
